Pedro Sáragga Leal, a partner from PLMJ Real Estate, has written an opinion article on the law that governs the activities of expert property valuers for "Promoção Imobiliária", the exclusive 2016 guide for real estate promoters and investors.
The PLMJ partner points out that "the law in question addresses liability for any losses caused to third parties, including clients of banks, beneficiaries of pension funds and real estate investment fund investors, etc., resulting from errors or omissions in property valuation reports made by the valuation experts. This law naturally provides that the valuation experts are liable for any such errors or omissions but – and this is the big change! – the company that hired the expert valuer is also jointly responsible, regardless of fault".
