PLMJ featured in ICLG: Corporate Investigations 2019

The third issue of The International Comparative Legal Guide to: Corporate Investigations 2019 was published recently and it offers a detailed analysis – from various jurisdictions –  of corporate investigations. This issue features a piece by Alexandra Mota Gomes, a Compliance partner, and José Maria Formosinho, a senior associate from the same practice area.

The two PLMJ lawyers have written a chapter on Portugal in which they look at the legislation applicable to corporate investigations, with reference to Law no. 83/2017 of 18 August. This Law sets out the measure to combat money laundering and terrorism financing.

Portugal does not have specific legislation on the issue of corporate investigations and it leaves the decision on whether these take place to the discretion of the companies themselves. Such investigations can, however, help to mitigate liability in the event of any infringement.

The ICLG: Corporate Investigations 2019 analyses common questions in the laws and regulations on corporate investigations – including internal investigations, disclosures by companies to regulatory authorities, the investigation process, confidentiality and lawyer-client privilege - in 28 different jurisdictions.
