A Multidisciplinary Vision

Healthcare, Life Sciences & Pharmaceuticals

The life sciences team was set up to respond to the need for legal advice in new areas linked to scientific know-how and development in biomedical technologies which have presented the greatest challenges in innovation and scientific development issues over recent decades.

The traditional issues of the pharmaceutical and research industries have been joined by new ones arising from the field of biomedical research (including nanotechnology, diagnostics, genomics, medical devices, bio banks, genetic testing and new medicines), of medical technologies (new fertility techniques and stem cell issues, and medical and genetic databases), and from the protection of biotechnological inventions (development and transfer of technology and patents).

The provision of solutions to the numerous issues raised by these new technologies requires a specialised response from the multidisciplinary group that makes up our life sciences team. It also requires an awareness of developments in Portuguese and international legislation and legislative policies in relation to regulation, enforcement and compliance. Wide-ranging experience together with knowledge of cutting-edge strategies for the protection of biological innovations are also essential.

Given the size and diversity of the health sector, providing health-related legal services requires an across-the-board knowledge of many different areas, foremost among which are:

  • Public procurement
  • Regulatory issues
  • Drug advertising
  • Competition
  • Product liability
  • Patents and trademarks
  • Taxation

In addition, the comprehensive restructuring that the services and regulatory bodies are currently undergoing, as well as changes to the status of hospitals and the contracting framework, the expansion of private hospitals and clinics and the increasing recourse to public-private partnerships to finance structural investment – just some of the measures which the current government is implementing in order to carry out its policies for fostering effective and efficient management in this sector - have presented new challenges to the market and to private investors. All of this has created a need for legal advice from lawyers who are highly qualified and specialised and have a keen focus on the healthcare sector.

Over the years PLMJ has advised large pharmaceutical companies and private sector groups on health sector financing and has also been involved in structuring and implementing public-private partnerships formed to make structural investments in healthcare.

The experience it has gained in carrying out this work means PLMJ’s multidisciplinary team of lawyers is ideally suited to this area where their specialised skills enable them to provide a comprehensive response to the needs of those operating in the health sector.
