Private Clients & Family Wealth

The Private Clients & Family Wealth team is made up of a group of lawyers with the experience and specialised technical skills to respond to the specific needs for legal support of individual clients, their families and their structures for wealth management and aggregation of family interests.

The team is organised into areas of specialisation because of the increasing complexity of theses matters and the wide range of issues faced by individual clients. The lawyers offer expertise combined with a pragmatic approach and impeccable standards of professional ethics, trust and confidentiality. 

The team provides legal support to its clients on a daily basis, to keep their objectives in focus and to add value at every step. The lawyers offer practical, commercial advice and place great importance on trust and mutual respect, based on a proactive approach. This team also has a multidisciplinary vision so, whenever necessary, it brings in lawyers specialising in other areas of law to ensure clients’ needs are fully met. These areas include Banking & Finance, Insurance, Real Estate, Tax, Employment and Labour, EU and Competition Law,and even Litigation. The team also works closely with the other consultants and professionals involved with clients in managing their private matters. This approach ensures efficient and proactive cooperation that is valued by our clients.

  • Wealth planning: We represent individual clients, family-based businesses, family offices, trusts, private foundations, private banks, insurers, asset managers and institutions and professionals active in the private wealth sector, according to their specific needs. We work predominantly on corporate, tax and estate planning matters with an international dimension. In wealth taxation, we provide tax advice on matters such as wealth management, succession planning, preservation of family assets, taxation of financial portfolios, life insurance and dedicated funds, restructuring and disposal of family businesses, structuring of inbound and outbound investment, implementation of philanthropy projects, acquisition of private aircraft and leisure craft, and procedures to establish domicile in Portugal.
  • Estate planning: Assistance to individuals or family structures in effective planning and timely implementation of the generational transfer of their assets, with a focus on cross-border issues, advice on constitution, management and termination of trusts and foundations, insurance and similar instruments, preparation of Portuguese and international wills, appointment of guardians, and administration of estates both in Portugal and internationally.
  • Family governance: advice to family businesses and family offices, often with assets and members in various different jurisdictions. We assist in preparing and implementing rules of governance to prevent conflicts and ensure the conditions necessary for the generational transfer or preservation of family wealth.
  • Family disputes: support to clients in all family related matters, whether in Portugal or internationally. These matters include divorces and their recognition in other countries, preparation of pre-nuptial agreements, maintenance between spouses or children, distribution of property upon death or divorce, adoptions, protection of minors and elderly persons with special needs, and the process for a declaration of incapacity.
  • Immigration and nationality: advice to individuals and their relatives on acquisition of Portuguese residence or nationality and family reunification;
  • Art law: we deal with the full range of matters arising from transactions and other matters involving art. In particular, we advise on acquisitions and transfers of works, authenticity and ownership rights, copyright, insurance, tax and customs arrangements, circulation, inventory and classification, and other issues of the law of cultural heritage. This component of the team is      particularly dynamic because of its proximity to the PLMJ Foundation, a non-profit body established by PLMJ to provide philanthropic support for art from Portugal and other member of the Community of Portuguese Language Countries (CPLP). Private Foundations & Philanthropy: we provide specialist legal support to entities in this sector, working in diverse segments, such as associations and foundations, in the national context and in their interactions with entities in other jurisdictions (charities, trusts, etc.). The team offers comprehensive legal assistance, in particular, in matters of patronage and philanthropy, regulatory and governance, tax law, public procurement and other forms of relationship with governmental entities.
