PLMJ lawyers write article for the European Competition Law Review

Competition specialists Ricardo Oliveira and Martim Valente have authored an article in the latest issue of the European Competition Law Review. 

In the article, Ricardo and Martim give an overview of the evolution of the Portuguese competition law landscape over time, with particular emphasis on recent developments.  The article highlights the Portuguese Competition Authority’s (PCA) approach to hub-and-spoke enforcement and analyses the degree of judicial review given to the PCA’s decisions by the Competition Court.

A number of suggestions on how the competition system could be reformed are also presented, for example: (i) extending the time defendant companies have to respond to PCA Statements of Objections and Decisions, (ii) a reform of the Public Prosecutor’s role in court appeals, (iii) providing more resources to the Competition Court, (iv) and expanding the review powers of the Court of Appeal in competition proceedings.
