The adversarial approach to conflict resolution in traditional forms of litigation offers no guarantees of speed, low costs or the ability to maintain the contractual and commercial relationships that are essential to companies to be able to continue to do business when the COVID-19 crisis is over.
In this note we present the alternative dispute resolution mechanisms capable of addressing these concerns. They are effective solutions which, in most cases can result in an enforcement title (a legal basis to bring an enforcement action). They are also speedy and efficient in the short and medium term, and they can be used to resolve both domestic and international disputes.
