Juliana Marcondes, an associate from PLMJ TMT, has written an opinion article on start-ups and software protection for the newspaper Observador.
In the article, she explains that "we have to bear in mind that, in the European Union, software is not protected by patents or any other special form of protection, as we sometimes hear in discussions on the topic. There has been much debate about these two possibilities. However, Directive 91/250/EEC of 14 May, on the legal protection of computer programs, provided established the Copyright Approach for protection of software in the Europe Union, under the same terms as literary works".
