PLMJ's Dispute Resolution team contributes to Freshfields guide


PLMJ Dispute Resolution team members Nuno Líbano Monteiro, senior partner, Carla Góis Coelho, partner, and Ana Raquel Frada, senior associate, wrote the chapter dedicated to Portugal in the 2023 edition of the guide "Class actions and collective claims around the globe", published by Freshfields Bruckhaus Deringer.

Analysing the situation in Portugal, the PLMJ experts say they expect the number of class actions, which has increased significantly in recent years, to continue to grow. They expect further growth in both consumer and competition law, as well as data protection and environmental law. This is particularly true in view of the increasing use of third-party litigation funding and the active role played by recently created associations for the protection of the environment and consumers' rights.

In this edition, particular attention has been paid to Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on collective actions for the protection of the collective interests of consumers. When incorporated into national law by the various Member States, this Directive may lead to significant changes in the rules governing collective actions, particularly with regard to the risk profile of these actions in some countries of the European Union.

This publication aims to identify trends and highlight the key issues and challenges that companies may face in the area of popular and collective actions.
