Digital Services Act: From European regulation to implementation in Portugal

On 31 July 2025, the Council of Ministers approved the government bill to implement the Digital Services Act (DSA) in Portugal.

The bill sets out the responsibilities of online intermediary service providers and defines rules to combat illegal content. It also appoints ANACOM as the competent authority for digital services in Portugal and specifies its powers and how it will collaborate with other bodies.

In light of recent developments in Portugal, it is crucial to grasp the key aspects of the DSA. The Act affects large technology companies that operate search engines and social networks. However, it also applies to virtual hosting services, marketplaces, app stores, and sharing economy platforms, regardless of their size or place of establishment.

Companies should analyse the extent to which the DSA applies to them. They should also review and update their internal policies and procedures by the deadlines set out in the Act.
